Conditions

The coopz app only allows an approximate location of friends that depends on many external factors that we have no control over. The coopz app is not designed to prevent emergencies but can only support the user's communication. For the Internet access of a terminal, the user is responsible and must carry any additional costs themselves.

1. Preamble

The following terms and conditions govern the contractual relationship between coopz GmbH, Schloßstr. 41a, 12165 Berlin, Federal Republic of Germany, registered in the commercial register of the district court Charlottenburg under HRB 197613 B (hereinafter referred to as "coopz") and the users who use the services of coopz (hereinafter "users") and define the conditions under which the use By registering with coopz, for example: http://www.coopz.io (hereinafter referred to as the "Website") and all referring domains as well as in the mobile apps for IOS and Android devices (hereinafter referred to as "Apps"), the user agrees to the terms and conditions below. The coopz app is exclusively for private use. Any commercial use is not included in the scope of services and is prohibited.

2. Contract

The contract between coopz and the user comes about with the free registration by the user in the mobile app.

The user can perform the free registration by completing the registration form. Alternatively, he can register via third-party connectivity features (e.g., Facebook Connect). Here, selected data from the respective profiles of the user are transferred to the coopz database. When registering via the Connect functions, the user agrees to the respective conditions of the third party providers and agrees that certain data will be transferred to the coopz database.

The use of the service is free in the basic functions. The user can purchase various "premium features" for a fee and the prices are clearly and visibly displayed to the user on the coopz website (www.coopz.io) as well as in the mobile apps before the final purchase, which Coopz retains Right to change these prices at indefinite time.

When booking premium features for a specific term, the user concludes a subscription that automatically renews, depending on the period selected by the user, unless the user terminates within the specified time limit of 24 hours before the end of the respective period:

Coopz expressly points out that only one user account may be created per user. In addition, coopz reserves the right to refuse users' registration without giving reasons.

If the user is under the age of 16, they must have the consent of their parent or guardian to these terms and conditions in order to use the service of the coopz App.

3. Termination of the contract

The user is entitled to cancel his profile at coopz at any time and thereby terminate the contract. In addition he finds in its account attitudes and in the mobile Apps a corresponding account delete function. Also a cancellation by fax or e-mail is possible.

After completion of the membership all data of the user are deleted from the coopz database promptly, as far as these are not needed for proof purposes of an illegal action of the user, beyond the contract termination.

4. User account

In order to use the coopz app, the user must first set up a user account via the app.

For this, the indication of the first name, which may also be a synonym, the phone number and a password is required. The user agrees to be responsible for his user account, password and all activities under his user account. In particular, the user is responsible for keeping his password secret. Furthermore, the user is obliged to take appropriate measures to prevent unauthorized use of his data, in particular passwords by third parties. He agrees to inform coopz immediately about a noticed or suspected unauthorized use of his account.

Profile pictures, nudity; Sexual and / or pornographic acts imply or show are not allowed. Copyrighted images where the user has no rights are also not allowed. Images depicting violence, drugs, weapons or the like must not be used. Pictures that show forbidden symbols may not be used as profile pictures.

5. Obligations of the user

The user undertakes not to intentionally specify the data of third parties (including e-mail address) as his own. In particular, he undertakes not to fraudulently specify the bank details or third party credit card details.

The user is obliged to use the application in such a way that no impairment, overloading or damage to it occurs and the purpose pursued by the application is neither endangered nor circumvented. The user may not circumvent or alter the security measures of the application, neither by himself nor by third parties.

It is forbidden to slander, harass, "stalk," or threaten others, or to spread inappropriate, defamatory, obscene, or suggestive information.

Personal data of other participants, which are transmitted to the user or become known, may not be processed by the user and not transmitted to uninvolved third parties. Other things only apply if the other party has given his consent.

The software provided to the user may not be copied, modified, reverse developed, decompiled and distributed.

6. Violation of user duties

Coopz has the right to content, profiles or individual profile pictures that violate these General Terms and Conditions or are unlawful, e.g. violate laws and regulations, in particular protection of minors, privacy, protection of personal rights, protection against insult, copyright, trademark rights violated by yourself.

7. Revocation

If the user is located in a country of the European Union, the use of coopz in the context of subscribing to paid subscriptions and the purchase of premium features is subject to the following right of withdrawal for consumers:

  • Cancellation
  • Withdrawal - You have the right to withdraw from this contract within fourteen days without giving any reason.
  • The revocation period is fourteen days from the date of conclusion of the contract.

In order to exercise your right of withdrawal, you must inform coopz GmbH (coopz GmbH, Schloßstr.41a, 12165 Berlin, Germany, Email: support@coopz.io) by means of a clear statement (eg a letter sent by post, fax or e-mail) inform about your decision to withdraw from this contract. You can use the attached model withdrawal form, which is not required.

In order to maintain the cancellation period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the cancellation

If you withdraw from this Agreement, we have selected all payments we have received from you, including delivery charges (except for the additional costs arising from choosing a different delivery method than the most favorable standard delivery we offer have to repay immediately and at the latest within fourteen days from the date on which the notification of your revocation of this contract has reached us. For this repayment, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you; In no case will you be charged for this repayment fees.

8. Liability

Coopz can not be held responsible for the fact that the information transmitted (for example the location of a friend, a chat message) is correct and complete and reaches the user on time.

For damages caused to the user by the use of the application, coopz is only liable for intent and gross negligence. In particular, in cases in which damage occurs through incorrect, incomplete or delayed transmission of information or a lack of availability or a malfunction of the application, coopz is liable only insofar as this was caused by intent or gross negligence. Incidentally, coopz is only liable for negligent breach of primary performance obligations. In this case, the liability is limited to typically objectively foreseeable damage.

If the user is responsible for an infringement, he releases coopz GmbH from liability towards third parties and the costs of appropriate legal defense. Incidentally, the user is in a culpable violation of the coopz GmbH for the replacement of reasonable legal defense free. Furthermore, in the case of a culpable violation, the user is obliged to compensate coopz GmbH for the damages incurred.

If coopz discontinues its service (coopz app) temporarily or permanently for good cause, in whole or in part, this circumstance does not constitute liability.

9. Data protection

10. Dispute settlement

The EU Commission provides a platform for online dispute resolution. This can be found here: www.ec.europa.eu/consumers/odr. Coopz is neither obliged nor willing to participate in a dispute settlement procedure before a consumer dispute resolution body.

11. Final provisions

Should any provision of these terms and conditions be ineffective, unenforceable or should they contain a gap, this shall not affect the validity of the remaining provisions. In place of the ineffective provisions or to fill the gap, a provision shall be deemed to be closest to the economic purpose of these Terms and Conditions.

We reserve the right to change these terms and conditions to comply with legal requirements or to capture a changed functionality of our app. If we change the terms and conditions to the detriment of the user, then we will inform him via email. The current version of the Terms and Conditions is available on the coopz website ( http://www.coopz.io/en/conditions.html ) as well as in the Smartphone App. The changes are considered as accepted by the user if he does not object to them within three weeks. We will inform the user about this at the beginning of the deadline. We reserve the right to terminate this agreement in the event of a contradiction.

All rights to the software remain with coopz GmbH.

The place of fulfillment is Berlin. German law applies.

Conditions

Any accounts and related accounts engaging in the activities specified below may be, at the sole discretion of FAN-LINE, temporarily locked and/or subject to permanent suspension. IF YOUR ACCOUNT IS PERMANENTLY SUS-PENDED DUE TO VIOLATION OF THE TERMS OF USE, IN GENERAL, OR ABUSIVE BEHAVIOR, SPECIFI-CALLY, NEITHER YOUR CREDITS NOR YOUR PRIOR TRANSACTIONS WILL BE REFUNDED.

A. PROHIBITED CONDUCT INCLUDES, BUT IS NOT LIMITED TO:
  • a) Violent threats (direct or indirect): You agree not to make threats of violence or promote violence, including threatening or promoting terrorism;
  • b) Harassment: You agree not to incite or engage in the targeted abuse or harassment of coopz employees, other users, or Entertainers;
  • c) Hateful conduct: You agree not to promote violence against or directly attack or threaten other people on the basis of race, ethnicity, national origin, sexual orientation, gender, gender identity, religious affiliation, age, disability, or disease;
  • d) Multiple account abuse: You agree not to create multiple accounts for the purpose of overlapping uses or in order to evade the temporary or permanent suspension of a separate account;
  • e) Private information: You agree not to publish or post other people's private and confidential information, such as credit card numbers, other payment information, street address, or Social Security/National Identity numbers, without their express authorization and permission. In addition, you agree not to post intimate photos or videos that were taken or distributed without the subject's consent;
  • f) Impersonation: You agree not to impersonate others through the coopz service in a manner that is intended to or does mislead, confuse, or deceive others; and
  • g) Graphic content: You agree not to use pornographic or excessively violent media in any images uploaded or posted on coopz.
B. SOME OF THE FACTORS WE MAY CONSIDER WHEN EVALUATING ABUSIVE BEHAVIOR INCLUDES BUT IS NOT LIMITED TO:
  • a) if a primary purpose of the reported account is to harass or send abusive messages to others;
  • b) if the reported behavior is one-sided or includes threats;
  • c) if the reported account is inciting others to harass another account
